Terms of Use

1. Provider and scope

DomainPortal is operated by KV GmbH, Johannisstr. 112, 49074 Osnabrück, Germany (“we”). These terms apply to DomainPortal accounts, free domain listings, domain parking and paid server plans. They apply to consumers and business customers. Contact: domain@kv-gmbh.de.

2. Accounts

You must provide accurate account and billing details and keep them up to date. Keep your login details secure and tell us promptly if you suspect unauthorised access. Your account starts when we accept your registration.

3. Services

You can list domains for sale free of charge. DomainPortal provides sale pages and tools for buyer inquiries. Parking displays pages that may contain advertising. Free parking capacity is limited; paid Cloud Server and Dedicated Server plans provide additional capacity. Available features and plan limits are shown before you order.

DomainPortal does not register or transfer domains. A buyer and seller arrange any domain sale, payment and transfer themselves. We do not guarantee traffic, advertising income, inquiries or sales.

4. Your domains and content

You must own each connected domain or have the owner’s permission to use it. You are responsible for the domains, prices, text, images, links and DNS records you provide, and for any legally required information on your own pages. You must have the necessary rights and keep sale information accurate.

Do not use DomainPortal for unlawful content, infringement, impersonation, fraud, phishing, malware, artificial advertising traffic or interference with the service. If you change your domain’s name servers, check that existing email and other DNS services will continue to work.

5. Prices and payment

Listings are free. Where offered, a Cloud Server costs EUR 49.99 net per month and a Dedicated Server costs EUR 99.99 net per month. Applicable VAT and the total price are shown before purchase. Paid plans are paid through PayPal, either as a monthly subscription or as a one-time payment for one month. A paid contract starts when we accept the order and payment is completed.

6. Term, cancellation and refunds

A PayPal subscription renews monthly until cancelled. You may cancel at any time through the available account function or by emailing domain@kv-gmbh.de. Cancellation stops future renewals; access continues until the end of the paid month. A one-time payment does not renew and access ends after one month.

You may close a free account at any time. We may end a free account with 30 days’ notice. Either party may end a contract for good cause where permitted by law. If a payment is refunded, the corresponding paid access period is shortened; mandatory statutory rights remain unaffected. Before service ends, change any name servers you want to use elsewhere, as affected domains may otherwise stop resolving.

7. Consumer right of withdrawal

If you are a consumer and conclude an eligible paid distance contract, you may withdraw within 14 days from the day the contract is concluded, without giving a reason. Send a clear statement to KV GmbH, Johannisstr. 112, 49074 Osnabrück, Germany, or domain@kv-gmbh.de before the period expires. You may use the model withdrawal form, but you do not have to.

If you withdraw, we will reimburse payments for the withdrawn contract within 14 days of receiving your statement, using the original payment method unless you agree otherwise. If you expressly requested that service begin during the withdrawal period, you may have to pay a proportionate amount for service already provided, where the legal conditions are met. Any legally required online withdrawal function remains available.

8. Availability and misuse

We operate DomainPortal with reasonable care, but maintenance and technical disruptions may affect availability. We do not promise a particular uptime or result. We may remove content or restrict a domain or account where reasonably necessary to address unlawful use, a serious breach of these terms or a security risk. You can report problems to domain@kv-gmbh.de. Statutory rights remain unaffected.

9. Liability

We are liable without limitation for intent, gross negligence and injury to life, body or health. The same applies to liability that cannot legally be limited. For slight negligence in breach of an essential contractual duty, our liability is limited to damage that was typical and foreseeable when the contract was made. Otherwise, liability for slight negligence is excluded to the extent permitted by German law.

10. Privacy

Our privacy policy explains how we process personal data. If you receive buyer inquiries or publish your own sale information, you remain responsible for any privacy duties that apply to your activities.

11. Changes to these terms

We may propose changes for valid reasons, such as changes in law, security or the service. We will give you the proposed text and effective date at least 30 days in advance. Material changes to an agreed service or paid price require your agreement or another valid legal basis. Silence alone does not count as agreement.

12. Final provisions and contact

German law applies. For consumers, this does not remove mandatory protections of the law of their usual place of residence. Courts in Osnabrück have jurisdiction only where a choice of court is legally permitted. If one provision is invalid, the remaining provisions continue to apply.
